DEC 181985 <br />BOOK 63 PAGE <br />INDIAN RIVER COUNTY ORDINANCE NO. 85- 103 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA, CREATING THE BREEZY VILLAGE <br />MOBILE HOME PARK RECREATION DISTRICT. <br />PURSUANT TO CHAPTER 418, PART 11, FLORIDA <br />STATUTES; PROVIDING A CHARTER THEREFOR; <br />PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, Chapter 418, Florida Statutes, authorizes x <br />county to create mobile home park recreation districts by ordinance <br />with boundaries to be that of the mobile home park in question, for <br />the purposes enumerated in Chapter 418, and, in particular, for the <br />purpose of levying and assessing a special assessment against each <br />mobile home parcel within the district to raise funds to acquire <br />and improve streets and lights, recreation facilities, and .other <br />common areas of all types, including real property and personal <br />property; and <br />WHEREAS, certain residents of Breezy Village Mobile <br />Home Park have petitioned the County to create such a mobile home <br />park recreation district; and <br />WHEREAS, the County finds that such a district would <br />be in the public interest; <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD <br />OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA. <br />that: <br />SECTION 1. CREATION AND CHARTER OF DISTRICT <br />This ordinance shall create and serve as the Charter for <br />the Breezy Village Mobile Home Park Recreation District. The <br />boundaries of the district shall be as shown on Exhibit "A" <br />attached to this ordinance. <br />SECTION 2. NO REFERENDUM REQUIRED <br />The Board of County Commissioners finds that a majority <br />of the electors of the proposed district has signed a petition <br />requesting that the County create the mobile home park recreation <br />district, and, therefore. pursuant to 5418.30, Florida Statutes, no <br />referendum shall be required to create the district. The petition <br />shall be kept on file at the Clerk's Office. <br />SECTION 3. GOVERNING BODY OF DISTRICT <br />The governing body of the district shall consist of a <br />nine -member board of trustees elected pursuant to 5418.302, Florida <br />Statutes. The date of the election required in subparagraph 2 of <br />9418.302 shall be the first Tuesday in March of each year; provided <br />that if at any time there are no more candidates for the office of <br />trustee than the required number, then no election need be held. <br />SUCTION 4. POWERS OF THE MOBILE HOME PARK <br />RECREATION DISTRICT; RECREATION DISTRICT TAX <br />The recreation district shall have all the powers and <br />duties as authorized by Chapter 418, Part 11, Florida Statutes. <br />50 <br />0 <br />
