Vitunac, <br />County Attorney <br />SUBJECT' Proposed Sebastian <br />Inlet District <br />Legislation <br />REFERENCES: <br />You asked me' to place this proposed bill on the January 8th <br />Board of County Commissioners' meeting agenda for formal <br />comment, and you asked for an interpretation of the language <br />of the proposed bill regarding who can be a member of the <br />Sebastian Inlet District. <br />Pursuant to Section 4 of the bill the governing body of the <br />Sebastian Inlet District will be five commissioners who will <br />be appointed by the Boards of County Commissioners of Brevard <br />and Indian River Counties. Brevard County will have three <br />appointments and Indian River County two appointments. The <br />members who will be appointed must be qualified electors and <br />residents within the boundaries of the District, and they must <br />live in the county they are representing. <br />Thus, the Board of County Commissioners of Indian River County <br />will have the power and duty to appoint two Indian River <br />County residents who are qualified electors of Indian River <br />County and who live in that part of the Sebastian Inlet <br />District which is within Indian River County. <br />58 <br />
