present Commission does not have good legal or accounting advice, <br />and that even with new appointments, we still might have the same <br />problems. <br />Attorney Vitunac advised that he would take the suggestions <br />back to his office and discuss them further with Senator Deratany <br />before the Legislative Delegation meets on January 15th. <br />PROPOSED_ SPECIAL ACT RELATING TO ANIMAL CONTROL <br />The Board reviewed the following memo dated 12/31/85: <br />TO: BOARD OF COUNTY DATE: December 31, 1985 FILE: <br />COMMISSIONERS <br />SUBJECT: PROPOSED SPECIAL ACT <br />RELATING TO ANIMAL CONTROL <br />i <br />FROM: James l lson REFERENCES: <br />Assist t County Attorney <br />This office has prepared a proposed special act providing Indian <br />River County Animal Control Officers with the power to issue <br />notices to appear for violations of the Indian River County -Code <br />of Laws a Ordinances, Chapter 3. As you may recall, a -similar act <br />was proposed by the Board of County Commissioners to the 1985 <br />Legislative Session, but was not adopted by the Legislature. <br />General Florida Law presently limits the authority to- issue a <br />notice to appear in the County Court to certain described law <br />enforcement officers. The County does not have the authority to <br />adopt an ordinance vesting its animal control officers with this <br />authority, in the absence of some special legislation from the <br />State. <br />This special act has been submitted to Representative R. Dale <br />Patchett and, with your approval, may be submitted to- the <br />Legislature for their consideration during the 1986 Legislative <br />Session. <br />Assistant County Attorney James Wilson explained that this <br />cannot be done by ordinance, it must be done by Special Act. He <br />noted that Brevard County also does this. <br />ON MOTION by Commissioner Wodtke, SECONDED by <br />Commissioner Bowman, the Board unanimously <br />authorized the Legal Department to submit the <br />special act to the Florida Legislature for their <br />consideration during the 1986 Legislative Session. , <br />,61 <br />JAN 81906 BOOK194 <br />
