JAN <br />15 <br />1986 <br />Boa <br />63 Pnr.287 <br />Director Davis <br />stated they had written them again <br />about <br />three weeks ago, but will be glad to write once more. <br />Commissioner Wodtke asked if the Board felt there should be <br />a Motion for staff to proceed with the rezoning, but it was felt <br />staff has been directed to follow through re this matter. <br />Director Keating inquired whether the Board wished the fees <br />for the site plan and special exception approval waived for the <br />college. Keating, P Old Dix. <br />Planning & Development Director DIS:BOB <br />It is requested that the following information be given formal <br />consideration by the Board of County -Commissioners—at --their- <br />regular <br />Commissionersat--their- <br />regular meeting of January 15, 1986. <br />DESCRIPTION & CONDITIONS <br />On December 28, 1985, Mr. Joseph Berlin submitted a letter to <br />_ the Board of County Commissioners, requesting that the County <br />not issue any new or renew any old certificates of occupancy <br />for the Old Dixie Shopping Center until the owners obtain a <br />state Department of Environmental Regulation stormwater manage- <br />ment permit for the project. As an individual with equitable <br />interest in.the project, Mr. Berlin has indicated that struc- <br />tural.. and other construction related problems exist with the <br />project and make it unsuitable for occupancy. He also contends <br />that the County erred in not having required the owners to <br />obtain a DER stormwater discharge permit prior to initiation of <br />construction of the project. <br />46 <br />
