RaaK. 63 Fp��� 2: <br />�9 <br />The Chairman noted that there is a question of whether or <br />not the County will be sued on this matter, and our Attorney, <br />therefore, has suggested that we swear in Mr. Berlin and anyone <br />else presenting testimony. He also asked that the Board and <br />staff not react too quickly today to things we do not have the <br />answer to at this time. <br />Joseph Berlin came before the Board and was sworn in by <br />Attorney Vitunac. <br />Mr. Berlin informed the Board that on November 10, 1983, <br />Mary K. Berlin had a site plan approved through Total Development <br />for a shopping center on South Old Dixie. She discarded these <br />plans later, and the property was sold. On July 11, 1984, site <br />plans and building plans were approved for Gary Parris to erect <br />the shopping center on land on Old Dixie and at that time he did <br />not own any land on Dixie Highway. Permits were issued in <br />violation of the law that says proof of ownership has to be <br />supplied to the county. Mr. Berlin reported that he had with him <br />copies of two deeds delivered on or about October 8th and 13th to <br />two different individuals - one being Gary Parris and the other <br />Dr. Thomas Springer. Now, we have two separate sites and we have <br />a building permit issued two months previous to Gary Parris on <br />the entire site, Mr. Berlin's question was how was a building <br />permit issued on two sites owned by two different people, and in <br />addition, no site plan was ever submitted and approved. <br />Attorney Vitunac recommended that the County get Mr. <br />Berlin's questions in writing and give him a formal correct <br />answer in writing within a set time frame. Since Mr. Berlin has <br />already stated in writing that he is going to sue the county, <br />Attorney Vitunac felt to protect our interests we must be -very <br />careful and exact. <br />Mr. Berlin next stated that it has been indicated that the <br />site plan received by Mary K. Berlin was transferred to the new <br />buyers. However, county law states that "Site plan approval <br />shall run with the land and shall transfer to a successor in <br />48 <br />
