JAN 15 1986 <br />BOLI( 63 rd.vr. <br />center sits 6 or 7" below the water table. When it rains heavy, <br />the water actually comes up through the parking lot breaking it <br />up. Severe settlement has been taking place inside the building <br />and one floor has dropped over 11". If we have two or three days** <br />rain, the retention area overflows the rear parking lot. They <br />have a septic tank just a few feet away from the retention area <br />that has an elevation of 22" above street level, and the two <br />buildings pump their sewage up into the septic tank. When it <br />rains, the water underground comes underneath Old Dixie and stops, <br />at the railroad tracks, and this area between the tracks and Old <br />Dixie is swampy. Thus, the situation arises where it is <br />possible, if the septic tank had full use, that it could be <br />filtering into the retention area. The retention area stays <br />full; there is growth in there; the drainage grills are 12-15" <br />below the water at all times, and it is becoming an unhealthy <br />situation. <br />Mr. Berlin informed the Board that application has been made <br />by a church to use this building temporarily while they build, <br />and that frightens him because they have 3-4' of water in a large <br />retention area and the sides slope and are muddy. If there are <br />young children there, they could run out there and slip in and <br />not get out, and he does not want to be responsible. The <br />insurance company is going to cancel the policy because they are <br />now aware of the fact that no legitimate permits were ever issued <br />on this project, and he did not feel he should be exposed to <br />lawsuits because of a problem in the various departments of the <br />county; therefore, he is asking for some sort of protection. <br />Mr. Berlin then presented another problem which he felt is <br />very serious. He noted that first of all, when that property was <br />split in half and two deeds prepared before construction started <br />that was illegal and made that property invalid because the law <br />specifically says that a subdivision has to be recorded before <br />You split the property.
