BOOK 63 ur 297 <br />Director Rymer believed that Mr. Autry knows the Code and he <br />contracted to build it as a building under one roof with <br />non-bearing partitions separating the tenants. She asked if it <br />is true that those are non-bearing walls. <br />Mr. Autry emphasized that he just built the building to <br />design, and the architect specified the wording. <br />Chairman Scurlock felt, in other words, Mr. Autry is saying <br />he just followed the plans and was not concerned with the form of <br />ownership, and Mr. Autry said that was exactly it; he was just <br />hired to construct the building to plans. He had nothing to do <br />with the ownership, the design or the engineering. <br />Chairman Scurlock believed Mr. Berlin is saying that this <br />structure is sub -standard; that it has defects and should not be <br />inhabited. As contractor of record, he wished to know if Mr. <br />Autry would not be responsible for construction of the building <br />and whether it would not be his responsibility to bring any <br />defects to someone's attention. <br />Mr. Autry advised that they have done regular inspections, <br />which is the regular procedure. They have noticed structural <br />defects because, they think, and also have advice from other <br />people (engineers and professional people), that the water table <br />is extremely high. There wasn't any water drain off on the <br />property site, and the water table is setting right underneath <br />the footer of the building. The damage occurring now is possibly <br />from the parking lot which is settling. He stated that they <br />noted this and reported it to the engineer and, of course, to the <br />owners. Mr. Autry stressed that the building was built properly, <br />all inspections done and passed, proper materials used, etc., and <br />they could not foresee the problems with the water. <br />Chairman Scurlock asked if Mr. Autry is saying the building <br />was built to Code and was structurally sound, but the structural <br />integrity is being threatened by the water table and the drainage <br />situation, and -Mr. Autry agreed. <br />56 <br />
