DESCRIPTIONS AND CONDITIONS: <br />The City of Vero Beach has submitted a right-of-way abandonment petition <br />requesting that the County abandon a 528 foot section of 14th Street <br />which lies 950 east of 27th Avenue. The City owns property to the north <br />and south of the right-of-way, the property to the north being within the <br />City limits, and plans to develop approximately 10.7 acres into a <br />recreational park (see Attachment #2). <br />The petition was reviewed by all County divisions and utility providers <br />having jurisdiction within the right-of-way, as per guidelines <br />established by the Board of County Commissioners for processing <br />right-of-way abandonment applications. All reviewing agencies, which <br />included the Public Works Division, the Utilities Division, Florida Power <br />and Light and Southern Bell recommended approval of the petition for <br />abandonment. <br />ANALYSIS <br />The 30 foot wide unimproved right-of-way is not part of the roadway <br />system as designated by the County Thoroughfare Plan and its need as such <br />is not anticipated. It is the opinion of the petitioners that the <br />right-of-way hinders the reasonable development of the 10.7 acre parcel <br />andjtherefore, its abandonment is being requested. <br />RECOMMENDATION <br />Staff recommends the County abandon its rights to the 30 foot wide 14th <br />Street right-of-way and authorize the Chairman of the County Commission <br />to execute the attached Resolution (Attachment #3). <br />Chairman Scurlock opened the Public Hearing and asked if <br />anyone wished to be heard in this matter. There were none. <br />ON MOTION by Commissioner Lyons, SECONDED by <br />Commissioner Bowman, the Board unanimously closed <br />the Public Hearing. <br />MOTION WAS MADE by Commissioner Lyons, SECONDED by <br />Commissioner Wodtke, that the Board adopt Resolution <br />86-03, providing for the closing, abandonment, and <br />vacation of that portion of 14th Street lying <br />approximately 950 feet east of 27th Avenue and <br />extending east for approximately 528 feet. <br />r <br />Under discussion, Commissioner Wodtke understood that by <br />doing this our title automatically transfers to the City of Vero <br />Beach and he wanted to be sure that this property will be used as <br />a park forever. <br />58 <br />JAN 2 2 1986 <br />BOOK 6 3 Frcr .386 <br />
