RESOLUTION NO. 98-"2 <br /> A RESOLUTION OF THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER COUNTY, <br /> FLORIDA, COMPLYING WITH THE LEGISLATIVE <br /> MANDATE IN SECTION 166.043(1)(C), F.S. TO <br /> ESTABLISH MAXIMUM FEES FOR TOWING <br /> SERVICES. <br /> WHEREAS, Section 166.043(1)(c), F.S., has directed counties to establish <br /> maximum fees which may be charged on the towing of vehicles;and <br /> WHEREAS,the Sheriff of Indian River County has established maximum fees <br /> entitled"Indian River County Sheriff's Office Rotation Towing Rate Structure";and <br /> WHEREAS, it appears that these fees are just, reasonable and reflective of the <br /> local market, <br /> NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER COUNTY,FLORIDA that: <br /> 1. The rate structure, as set forth in Exhibit"A" shall apply to the towing of <br /> vehicles from or immobilization of vehicles on private property, removal and storage <br /> of wrecked vehicles from an accident scene or for the removal and storage of vehicles <br /> in the event the owner or operator is incapacitated, unavailable, leaves the <br /> procurement of wrecker services to the law enforcement affair at the scene, or <br /> otherwise does not consent to the removal of the vehicle. <br /> 2. The rate structure is set forth as Exhibit"A" to this Resolution. <br /> The resolution was moved to adoption by Commissioner F r a n A d a m s <br /> and the motion was seconded by Commissioner C a r o 1 i n e Ginn, and, upon being <br /> put to a vote,the vote was as follows: <br /> Chairman John W.Tippin Absent <br /> Vice Chairman Kenneth R.Macht Aye <br /> Commissioner Fran B.Adams Aye <br />
