Boos 6 u 5`'� <br />CONCLUSION: Subdivision of the center conformed to County <br />ordinances; terminology reflects subdivision ordinance <br />definitions. In County codes, party wall subdivision and <br />land condominium are synonymous. <br />RECOMMENDATION <br />The staff recommends that the Board of County Commissioners accept <br />the staff analysis and provide Mr. Joseph Berlin with this formal <br />reply to his questions. <br />Commissioner Lyons noted that staff has stated that it is <br />their position that Mary K. Berlin violated the site plan <br />ordinance, and he wished to know what action we are taking in <br />that regard. <br />Director Keating stated that right now staff had not planned <br />on taking any action unless the Board directed them to. He <br />explained that there is definite specific action that would be <br />taken re such a violation i'f it was found out during the site <br />plan process, but after site plan approval has been completed and <br />a C.O. issued, no specific action is referenced in the ordinance. <br />County Attorney Vitunac noted that every violation of an <br />ordinance is a misdemeanor and could be taken to county court if <br />desired; otherwise, it goes to the Code Enforcement Board. He <br />believed Director Keating is saying this isn't the type you would <br />want to take to criminal court or the Code Enforcement Board. <br />Director Keating confirmed that he did not feel it would go <br />to the Code Enforcement Board as that body sets requirements for <br />rectifying the violation, and in this case actually the require- <br />ments have been met, and a C.O. has been issued. <br />Commissioner Wodtke noted that there are some tenants in <br />those buildings who are wondering just what the situation is - <br />whether they are going to be evicted or the building condemned, <br />and he would like them to know that actually there is no action <br />recommended for the county to take. <br />Director Keating concurred that staff basically responded to <br />the questions raised by Mr. Berlin, and staff does not recommend <br />that any specific action be taken. Mr. Berlin is the one who was <br />requesting action, and the Board declined. <br />32 <br />
