EP 1996 Boa 63 56,37 <br />J <br />Commissioner Bird stated that, as he understood it, if you <br />had a ticket for such a violation, you would be prohibited from <br />leasing a space, but would you be prohibited from coming into the <br />marine for service, a sandwich, etc.? <br />Commissioner Lyons emphasized that this has been debated in <br />the Council at length, but they still voted for it. He would <br />suggest that we just take care of seeing if the conditions have <br />been met through the annual report. <br />Question arose as to what happens if we disagree with the <br />amendments proposed, and Commissioner Lyons believed it then will <br />go to the Governor and Cabinet, and since the developer has <br />already agreed to these amendments our chances of winning an <br />argument about this in Tallahassee are pretty slim. <br />Commissioner Bowman noted that in St. Lucie they have agreed <br />to enforce this, and they are doing it now. <br />The Chairman asked if anyone present wished to be heard. <br />There were none. <br />ON MOTION by Commissioner Wodtke, SECONDED by <br />Commissioner Bird, the Board unanimously closed <br />the public hearing. <br />MOTION WAS MADE by Commissioner Lyons, SECONDED by <br />Commissioner Bird, to adopt Resolution 86-04 amend- <br />ing the adopted Grand Harbor Development Order. <br />Commissioner Bird felt it probably would be futile to <br />include any language about enforcement, and Chairman Scurlock <br />stated that he would like staff to come up with an appropriate <br />fee structure to pay for any services we are going to be <br />rendering re enforcement. <br />Commissioner Wodtke felt if we collect money, we will have <br />to enforce this, and Commissioner Bird believed the enforcement <br />involves only the owners of the slips, not transients. <br />48 <br />r <br />
