FF,_ <br />BOOK 63 r uC 56 A <br />The proposed dock facility will be located within the Malabar - <br />Vero Beach State Aquatic Preserve and, as such, is subject to <br />Chapter 16Q-20 Florida Administrative Code. A staff review of <br />Chapter 16Q-20 finds that the proposed dock dimensions do not <br />comply with the size standards set forth in the Code. The <br />Florida Department of Natural Resources will not issue a lease <br />to the submerged lands until all of the requirements to Chapter. <br />16Q-20 have been met by,the applicant. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners autho- <br />rize staff to transmit a letter to the D.E.R. recommending <br />against the issuance of a permit for this project as it is <br />currently submitted. Staff further recommends that the appli- <br />cant resubmit the application along with a complete site plan <br />application to the Planning & Development Division for review <br />and coordination. <br />Planner Challacombe informed the Board that staff did have a <br />preapplication conference with Mr. Schwarz on his proposed dock, <br />which is to be an accessory use to a townhouse development in the <br />Roseland area. Mr. Schwarz was informed that an accessory use <br />has to be associated with a primary structure, and plans must be <br />submitted and approved, etc. He did not believe the applicant <br />has any problem with resubmitting as proposed. <br />Commissioner Bowman inquired just where this is to be <br />located, and Planner Challacombe stated just north of Judah's <br />Fish Market where there presently is an old and historic two <br />story house. <br />Commissioner Lyons asked Mr. Schwarz if he had any objection <br />to staff's recommendation, and Mr. Schwarz did not. <br />ON MOTION by Commissioner Lyons, SECONDED by <br />Commissioner Bowman, the Board unanimously <br />authorized staff to transmit a letter to the <br />DER recommending against issuance of a permit <br />for the project as currently submitted; the <br />applicant to resubmit his application. <br />DOCUMENTS TO BE MADE A PART OF THE RECORD <br />Lease Agreement with Edgar Schlitt, Trustee, for space in <br />the 2001 Building, as approved at the Regular Meeting of <br />78 <br />7— <br />
