FEB 12 196 Boa fil Pnur 9 <br />ORDINANCE N0. 86- 16 <br />AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS <br />AMENDING INDIAN RIVER COUNTY ORDINANCE SECTION 25(0) <br />[signs]; PROVIDING DEFINITION OF ADVERTISING STRUCTURE; <br />PROVIDING DEFINITION OF SIGN; PROHIBITING BUILDING <br />STRUCTURES WHICH RESEMBLE IN CONFIGURATION OR DESIGN A <br />PARTICULAR PRODUCT; INCORPORATION IN CODE; SEVERABILITY <br />AND EFFECTIVE DATE. <br />WHEREAS, the Board of County Commissioners of Indian <br />River County desires to enact amendments to the sign ordinance of <br />Indian River County; and <br />WHEREAS, it is the purpose and intent of these amend- <br />ments to promote and protect the public health, safety, welfare <br />and aesthetics of Indian River County by regulating and limiting <br />the public display of advertising structures, signs, billboards, <br />and other displays competing for public attention; and <br />WHEREAS, it is the intention of the Board to repeal and <br />replace emergency ordinance 86-13 with this ordinance; <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS that: <br />C7rmTnM 1 <br />Indian River County Ordinance Section 25(0)(1) Special <br />definitions is hereby amended to establish Section 25(o)(1)h. and <br />Section 25(o)(1)i. to read: <br />Advertising Structures: Any structure, with <br />or without any advertisement display <br />thereon, situated upon or attached to real <br />property, upon which any sign may be placed. <br />Anytime the word "sign" is used in this sign <br />ordinance [Section 25(0)], the same shall include <br />advertising structure. <br />Sign: Any writing; pictorial representation; <br />decoration; emblem (except a religious emblem); <br />flag (including banner or pennant); or any other <br />structure, figure, or character, or any part <br />thereof, on which such writing, pictorial <br />representation, emblem, flag, or other figure <br />or character is installed or placed which: <br />a. is used to inform, attract attention, or <br />advertise; and <br />b. is readily visible from any public place <br />off the premises upon which the writing, <br />pictorial representation, decoration, <br />emblem, flag, figure or character is located. <br />Whenever the word "sign" appears in this sign <br />ordinance [Section 25(0)] it shall include <br />"advertising structure." Whenever the word "sign" <br />is used in this sign ordinance [Section 25(0)] it <br />shall include buildings or other structures shaped <br />to resemble in configuration or design a product <br />for sale such as, but not limited to, hot dogs, <br />hamburgers ice cream cones, shoes, automobiles, <br />or fruit. <br />28 <br />
