r <br />FEB <br />12 1986 <br />BOOK <br />6pnF604 <br />land clearing and/or tree removal permit. <br />He noted <br />that <br />a land <br />clearing permit is $45.00, and the purpose of obtaining one is so <br />that staff can get on the site before it is cleared and determine <br />whether there are any protected trees on it. <br />Commissioner Lyons did believe there has been sufficient <br />publicity about this type of violation to make people aware, and <br />he further noted that another argument is that ignorance is no <br />defense. <br />Commissioner Wodtke felt that mainly violations which have <br />received publicity have been for tree removal. He did feel it is <br />necessary to follow our ordinance and believed we have got word <br />out to the contractors. The Ryall family, however, is a well <br />known, old county family, and he suggested consideration be given <br />to the fact that Mr. Ryall has applied for an after -the -fact <br />permit and that he be required to pay double, or $90.00. <br />Commissioner Lyons stated that he would settle for $250.00, <br />and Commissioner Bowman recommended $300.00. <br />Planner Challacombe advised that on at least one past <br />occasion with similar circumstances, a respondent was fined <br />$150.00. <br />Chairman Scurlock believed we have levied some significant <br />fines on some other well known citizens who have pleaded <br />ignorance; he, therefore, stated that he would support a fine of <br />$150.00 as being consistent with what we have done in the past. <br />Chairman Scurlock asked the cooperation of the Press to <br />perform a civic duty by doing some stories about what is and is <br />not covered under the ordinance. <br />Commissioner Bird felt the Ryalls are well informed people <br />and he did not believe they intentionally violated our ordinance. <br />ON MOTION by Commissioner Lyons, SECONDED by Com- <br />missioner Bird, the Board unanimously agreed on a <br />fine of $150.00 for RASO Corporation, this amount <br />to include the cost of the land clearing permit. <br />36 <br />
