S'." _ .►0\ <br />It is requested that the data presented herein be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting on February 26, 1986. <br />DESCRIPTION AND CONDITIONS: <br />During the 1985 session the "Coastal Zone Protection Act of <br />1985" was enacted by the Florida Legislature. The provision of <br />this act requires all local governments with jurisdictions <br />fronting on the Gulf of Mexico, Atlantic Ocean, Florida Bay, or <br />Straits of Florida to establish a "coastal building zone" and <br />coastal building code. Within the designated zone increased <br />minimum standards for construction of major habitable <br />structures will apply. As prescribed in this legislation, <br />local governments have two basic responsibilities: <br />1) implement new building code requirements for coastal <br />areas; and <br />2) delineate the geographic boundary of the coastal building <br />zone for their respective jurisdictions. <br />On November 22, 1985, the Community Development Department <br />received a memorandum from the Florida State Department of <br />Community Affairs notifying Indian River County that Florida <br />must establish a coastal building zone and code by March 1, <br />1986. <br />ALTERNATIVES AND ANALYSIS: <br />The proposed ordinance delineates the coastal building zone for <br />the unincorporated portion of Indian River County. Because the <br />area affected by the legislation is a coastal barrier island <br />fronting the Atlantic Ocean, the County coastal building zone <br />is to be measured 5,000 feet landward from the Coastal <br />Construction Control Line (CCCL.) Coastal barrier islands are <br />defined as geological features which are completely surrounded <br />by marine waters and that front upon the Gulf of Mexico, <br />Atlantic Ocean, Florida Bay, or Strait of Florida. <br />The 5,000 foot measurement is a requirement of the legislation; <br />however, the County may elect to include the entire barrier <br />island under the requirements of the coastal building zone. <br />If the County fails to adopt a coastal building zone, it may be <br />subject to sanctions by the Administration Commission. <br />The enclosed attachments generally depict the location of the <br />proposed coastal building zone for the unincorporated portion <br />of*the County.
