DEPARTMENT OF ENVIRONMENTAL REGULATION APPLICATION <br />NO. 31-115984-4 <br />APPLICANT: Mr. Romas Sakalas <br />300 Harbor Drive <br />Vero Beach, Florida 32963 <br />WATERWAY & LOCATION: The project is located in the Indian <br />River adjacent to Windward Way in Section 28, Township 33 <br />South, Range 40 East, Indian River County, Florida. <br />The upland property associated with the project is located at <br />176 Windward Way, Vero Beach, Florida. <br />WORK & PURPOSE: The applicant has applied for an "After the <br />Fact" D.E.R. permit for the construction of a private single <br />L-shaped dock, extending 15 feet waterward, 8 feet in width. <br />The terminal platform dimensions are 4 feet in width and 24 <br />feet in length. No sewage pump -out or fueling facilities are <br />associated with the project. No dredging or filling has or is <br />to occur due to the project. <br />ALTERNATIVES & ANALYSIS: <br />The Planning and Development Division reviews and submits <br />comments on dredge and fill applications to the permitting <br />agencies based upon the following: <br />- The Conservation & Coastal Zoning Management Element of <br />the Indian River Comprehensive Plan <br />- Coastal Zone Management, Interim Goals, Objectives & <br />Policies for the Treasure Coast Region <br />- The Hutchinson Island Planning & Management Plan <br />- The Indian River County Code of Laws and Ordinances <br />Chapter 16Q-20 of the Florida Administrative Code sets parame- <br />ters for private residential single docks located in the <br />Indian River Aquatic Preserve. Section 16Q -20.04(5)(b), <br />Florida Administrative Code, sets forth specific design <br />standards and criteria for private single docks, among which <br />is the criterion that "Any main access dock shall be limited <br />to a maximum width of four (4) feet" (16Q -20.04(5)(b)(1) ). <br />Staff has not determined if the dockage -project location is in <br />the Aquatic Preserve or if it is located on privately owned <br />bottomlands. If the project is located in the Preserve, the <br />dock is in conflict with the above cited criterion. <br />No dredging or filling is associated with the private single <br />dock project. In that respect, the project results in minimal <br />additional impact to an area where private single docks have <br />been previously permitted. <br />Although the extent of any impacts are not fully known at this <br />time, there may be cumulative impacts of these and other <br />dockage projects proposed to be constructed along the Indian <br />River upon the Florida Manatee. <br />5 <br />BOOK 63 F�� <br />
