Deeds - Vista Royale Water Plant Property <br />ON MOTION by Commissioner Lyons, SECONDED by Commis- <br />sioner Wodtke, the Board unanimously approved the <br />following deeds re the Vista Royale Water Treatment <br />Plant and authorized the signature of the Chairman. <br />DEED OF EASEMENT <br />THIS DEED, dated this 12th day of March , 1986, <br />between INDIAN RIVER COUNTY, hereinafter called Grantor, which <br />terms shall include when used herein, whatsoever the.context so <br />requires or admits, its successors and assigns, and VISTA ROYALE <br />ASSOCIATION, INC., hereinafter called the Grantee, which terms <br />shall include when used herein, whatsoever the context so <br />requires or admits, its successors, and assigns; <br />W I T N E S S E T H: <br />For the sum of Ten and no/100 Dollars ($10.00) and other <br />good and valuable consideration, the receipt and sufficiency of <br />which is hereby acknowledged, Grantor does hereby grant, bargain, <br />sell, alien, remise, release, convey and confirm unto Grantee the <br />following: <br />A perpetual non-exclusive easement for ingress and egress to <br />Vista Royale Water Treatment Plant property across and under a <br />twenty-five foot (251) strip of land lying adjacent to the east- <br />erly boundary of area F (the Vista Royale Water Treatment Plant), <br />the northerly boundary of the commercial area and the westerly <br />and southerly boundaries of Phase 3, Vista Royale Condominium, <br />all as shown on Exhibit "X" to the Declaration of Condominium for <br />Vista Royale, which Exhibit is a boundary line survey recorded in <br />Official Record Book 591, at Page 2516, of the Public Records of <br />Indian River County, Florida; being that easement depicted on the <br />attached Exhibit "A" as the "25' Easement"; subject to the fol- <br />lowing conditions, which shall be binding upon the Grantee, its <br />successors and assigns: <br />A. The Vista Royale Water Treatment Plant property (the <br />"Water Treatment Plant Property") will be screened by the Gran- <br />tee, its successors and assigns, along its North, South and West <br />Boundaries, by the planting of trees or hedges or erection of <br />fences. This screening will be completed by December 31, 1986. <br />B. The Water Treatment Plant Property will be maintained in <br />a neat and orderly manner and may be used only by VISTA ROYALE <br />ASSOCIATION, INC., the Florida not-for-profit corporation respon- <br />sible for the operation of Vista Royale Condominium for the main- <br />tenance and storage of equipment, supplies and other personal <br />property. <br />C. The Grantee, its successors and assigns, will maintain <br />the existing paving upon the easement depicted upon the attached <br />Exhibit "A" as the 25' Easement and the Grantee, its <br />and assigns, will also maintain all existing paving <br />North of and adjacent to a fifteen foot (15' ) strip <br />ignated as 15' Easement upon Exhibit "A". <br />10 <br />successors <br />upon the land <br />of land des- <br />
