Boa 63 FADE 853 <br />MAR 12 1986 7 <br />Chapter 16Q-20 of the Florida Administrative Code sets parame- <br />ters for private residential single docks located in the <br />Indian River Aquatic Preserve. Section 16Q -20:04(5)(b), <br />Florida Administrative Code, sets forth specific design <br />standards and criteria for private single docks, among which <br />is the criterion that "the dock will extend out from the <br />shoreline no further than to a maximum depth of minus four <br />(-4) feet (mean low water) " (16Q-20..04 (5) (b) (3) ) . <br />Staff has not determined if the dockage project location is in <br />the Aquatic Preserve or if it is located on privately owned <br />bottomlands. If the project is located in the Preserve, the <br />dock ia"y be conflict with the above cited criterion; the <br />applicant has not provided sufficient information concerning <br />mean low water depth. <br />No dredging or filling is associated with the private single <br />dock projbct. In that respect, the project results in minimal <br />additional impact to an area where private single docks have <br />been previously permitted. <br />Although the extent of any impacts are not fully known at this <br />time, this and other proposed dockage projects in the Indian <br />River may result in negative cumulative impacts upon the <br />Florida Manatee. <br />Staff has not determined the extent to <br />bottomlands of the proposed project area <br />effect of Indian River development on <br />seagrass beds should be considered. <br />RECOMMENDATION: <br />which the submerged <br />will be impacted; the <br />ecologically valuable <br />It is recommended that the Board of County Commissioners <br />authorize staff to forward the following comments regarding <br />this project to the Florida Department of Environmental <br />Regulation: <br />1) The Department of Environmental Regulation and other <br />appropriate agencies should coordinate with the D.N.R. to <br />determine if the project is located in the Indian River <br />_ Aquatic Preserve and therefore subject to requirements of <br />Chapter 16Q-20, Florida Administrative Code. <br />2) The Department of Environmental Regulation and other <br />appropriate agencies should consider the potential <br />cumulative impacts of dockage projects upon the Florida <br />Manatee. <br />3) The Department of Environmental Regulation and other <br />appropriate agencies should evaluate the potential impact <br />of marina projects on ecologically significant submerged <br />bottomlands such as seagrass beds in the Indian River. <br />ON MOTION by Commissioner Lyons, SECONDED by Commis- <br />sioner Wodtke, the Board unanimously authorized <br />staff to forward their comments to the DER as set <br />out in the above memo. <br />I.
