TO: The Honorable Members of DATE: February 27, 1986 FILE: <br />the Board of County Commissioners <br />SUBJECT: Pistol Permit Renewal - <br />Julius Kabanek <br />FROM: Michael Wright REFERENCES: <br />'County Administrator <br />The following individual has applied through the Clerk's Office for <br />renewal of pistol permit. All requirements of the ordinance have <br />been met. <br />Attached are letters from individuals objecting to the issu- <br />ance of a pistol permit for Julius Kabanek. The letters are self- <br />explanatory. <br />Please advise if there are any questions. <br />The letters of objection received were from William P. <br />Weyforth and Nathan Goldman, both next door neighbors of Mr. <br />Kabanek. Mr. Weyforth spoke of problems with the Kabanek's wind <br />chimes and Mr. Goldman feared Mr. Kabanek would harm his cat. <br />Both stated that Mr. Kabanek had issued threats, and Mr. Weyforth <br />stated that in one instance "a fire arm was involved." These <br />letters are on file in the office of Clerk to the Board. <br />Chairman Scurlock asked the County Attorney what our legal <br />options are, and Attorney Vitunac advised that state law requires <br />the applicant be 18 years of age, of a good moral character, and <br />not have been convicted of a felony. The only way this permit <br />could be denied would be if the Board found the applicant was not <br />of good moral character based on the objections from the <br />neighbors. <br />Commissioner Bird felt this obviously is a neighborhood <br />squabble and there are always two sides to such a dispute; he <br />believed we should do further investigation. <br />It was noted that those objecting were not present. <br />Chairman Scurlock informed Mr. Kabanek that the Board takes <br />the responsibility of issuing these permits very seriously and <br />asked if he wished to make a response to these objections. <br />5 <br />MAR 12 1966 63' p,�cE8x38 <br />
