r <br />MAR 1.9 1986 3/5/86 ( �Le .� � 4 <br />TOWER SPACE LEASE ��� f . �r.. <br />STATE OF FLORIDA <br />COUNTY OF INDIAN RIVER <br />Indian River County Board of County Commissioners, <br />hereinafter called "Lessor," and COMMUNICATIONS OF VERO, <br />hereinafter called "Lessee," agree as follows: <br />W I T N E S S E T H: <br />1. In consideration of rents, covenants, and agreements <br />hereinafter reserved, the Lessor does hereby grant permission to <br />the Lessee to install and operate the following described radio <br />and operation equipment of Lessor's property at: <br />Riwanis-Hobart Park <br />Indian River County, Florida <br />Latitude: 21°14'10" <br />Longitude: 80° 27126" <br />A. Antenna to be located 400 feet above ground level. <br />B. Flexible coaxial transmission line between antenna <br />and radio equipment. Such coaxial line to be anchored firmly to <br />the tower. <br />C. Radio communications equipment consisting of <br />transmitter, receiver and accessories to be installed in the tower <br />equipment shed located at the base of the tower to encompass an <br />area not to exceed 18 square feet. <br />D. Committed tower utilization space, including <br />protective clearance above and below the antenna(s), not to exceed <br />20 feet. <br />2. The term of the lease and the Lessee's obligation to pay <br />rent shall commence on the 1st day of January, 1986. The term of <br />this lease shall be 2 years following the commencement of the term <br />provided herein and may be renewed annually thereafter unless <br />within thirty days prior to the expiration of the term thereof, or <br />any renewal under this provision, either the Lessor or the Lessees <br />shall notify, in writing the other party to this lease that it <br />does not desire to have the lease renewed. The Lessor reserves <br />`the right to terminate this agreement upon sixty days prior <br />written notice by Lessor to Lessee that the property is needed for <br />an overriding public purpose. <br />The rent for each succeeding year may be subject to review <br />and renegotiation yearly no less than sixty days prior to the <br />renewal date contained herein. In the event the -parties hereto <br />fail to agree upon a reasonable rental fee for the following year, <br />this agreement shall terminate automatically pursuant to the terms <br />stated herein. <br />The Lessor shall have the right to terminate this lease at <br />any time if: <br />A. Lessee's operations at any time or in any way <br />interfere with those of the Lessor and cannot be fixed within a <br />reasonable time. <br />B. Lessor decides to abandon the facility leased, or <br />remove the same from its present location to a new location. <br />-1- <br />
