Joint Resolution No. <br />A joint resolution proposing an amendment to <br />the State Constitution by adding a new section <br />16 to Article X relating to local control of <br />gaming activities if authorized by law. <br />BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF FLORIDA: <br />That the new Section 16 of Article X of the State Constitution <br />set forth below is agreed to and shall be submitted to the electors <br />of Florida for approval or rejection at the general election to be <br />held in November, 1996: <br />SECTION 16. Gaming and Gambling Activities; Local Control and <br />Regulation. Notwithstanding any other provision of this <br />constitution to the contrary, any gaming or gambling activity <br />authorized by law, except for pari-mutuel pools authorized pursuant <br />to Article X, Section 7 and state operated lotteries authorized by <br />Article X, Section 15, shall be subject to local control and <br />regulation by the county or municipality wherein such activities <br />are authorized as to all land use matters, zoning, building and <br />similar codes, hours of operation and related regulatory matters. <br />Any proposed amendment to this constitution relating to the <br />authorization of gaming or gambling activities shall provide for <br />voter approval within a county prior to any gaming or gambling <br />activity being authorized therein and such activities shall be <br />subject to 2.ocal control and regulation by the county or <br />municipality wherein such activities are authorized as to all land <br />use matters, zoning, building and similar codes, hours of operation <br />and related regulatory matters. <br />
