be relieved of any liability, but if we give them to the Society, <br />we are still responsible for those documents. <br />Discussion ensued in regard to letting the Society pick them <br />up at the dump, but Mr. Woodard pointed out that when they are <br />taken to the dump, the Clerk is certifying that they have been <br />covered and obliterated. <br />Chairman Scurlock did not understand the purpose of that, <br />and Mr. Woodard stated this is the Catch 22 with the State. <br />The Chairman felt this can be solved, and Mr. Woodard hoped <br />so because he went to two seminars and also to the Attorney <br />General for an opinion and they won't budge from their position. <br />Commissioner Lyons noted that apparently there is no good <br />reason for it - it is just their policy, and Mr. Woodard <br />confirmed that is 1A exactly. The Clerk has taken the position <br />at this point that she is not in a position to give those records <br />to the Historical Society and still have the responsibility for <br />them, but hopefully something can be worked out. <br />Commissioner Wodtke suggested we put our attorney to work on <br />this. <br />Attorney Vitunac brought up the Clerk's responsibility for <br />sealed records, and noted that if the records are simply given en <br />masse to someone else, they might open up adoption papers, etc. <br />Chairman Scurlock assumed if it is a sealed type of thing, <br />you take it and dispose of it as they can be identified. <br />Attorney Vitunac stated that from what he understands what <br />is under the Clerk is the Clerk's and before these people touch <br />anything Mr. Woodard is going to have to say it is all right. <br />Mr. Woodard confirmed that is correct as far as the records <br />of the Clerk are concerned, but there are Board records in the <br />basement - Planning Department data, maps, etc.- not under the <br />Clerk's jurisdiction. <br />Chairman Scurlock stated that the Historical Society can <br />have all those. <br />49 <br />APR 2 1986 Boor; 64 racr 49 <br />
