r 4/2/86(R-4)LEG(Vk) <br />APR 9 '1986 <br />RESOLUTION NO. 86- 16 BOOK 64 P'GF 1910 <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, <br />AUTHORIZING A WASTEWATER RATE INCREASE FOR <br />GENERAL DEVELOPMENT UTILITIES, AMENDING THE <br />ORIGINAL RESOLUTION DATED 4/5/60, AS AMENDED <br />WHEREAS, on the 19th day of March, 1986, General <br />Development Utilities, Inc. (GDU) pursuant to a properly filed <br />and noticed request for rate relief, appeared at a public hearing. <br />before the Board of County Commissioners of Indian River County, <br />Florida (Board) ; and <br />WHEREAS, the Board received and reviewed documentary <br />exhibits as filed on behalf of General Development Utilities, <br />Inc. and had the opportunity to <br />question <br />GDU and, in <br />addition, <br />allowed for comment from citizens <br />of Indian <br />River County <br />residing <br />within the franchise area; and <br />WHEREAS, the Board found that GDU was entitled to receive <br />the rate relief requested; and <br />WHEREAS, the Board approved the required changes in GDU's <br />approved tariffs to reflect the rate relief requested, changes in <br />rate structures, deposits and connection charges; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY that the Resolution dated <br />April 5, 1960, between Indian River County, Florida, and <br />General Development Utilities, Inc., as subsequently amended <br />by Resolutions Nos. 77-95, 80-15, 81-101, and 83-122, is hereby <br />amended as follows: <br />S-ECTION' '14 <br />The rates charged by GDU for its service hereunder shall be <br />fair and reasonable and designed to meet all necessary costs of <br />the service, including a fair rate of return on the net valuation <br />of its properties devoted thereto under efficient and economical <br />management. GDU agrees that it shall be subject to all authority <br />now or hereafter possessed by the County or any other regulatory <br />body having competent jurisdiction to fix just, reasonable, and <br />compensatory rates. When this franchise takes effect, GDU shall <br />have authority to charge and collect not to exceed the following <br />schedule of rates, which shall remain effective until changed or <br />modified as herein provided, to -wit: <br />-1- <br />
