® ® r <br />Commissioner Bird pointed out that the needs were based on <br />population projections, and Chairman Scurlock wondered if we <br />should update the report first before committing ourselves to the <br />condemnation. <br />Attorney Vitunac believed we should go ahead with the letter <br />to the State right now and do the report and all the backup <br />later, because the Board can decide to back out at some future <br />time. <br />Chairman Scurlock asked when the court costs would begin, <br />and Attorney Vitunac explained that would not happen until we <br />file a resolution of taking. <br />MOTION WAS MADE by Commissioner Bird, SECONDED <br />by Commissioner Lyons, that the Board authorize <br />staff to update the beachfront acquisition report <br />and bring those findings back to the Board at the <br />earliest opportunity and make the determination to <br />acquire the Howell/Chapman property through purchase, <br />trade, or condemnation if required. <br />Under discussion, Commissioner Wodtke expressed his doubts <br />about our chances of winning a condemnation action and suggested <br />that we divert this money into another piece of beachfront <br />property where our chances would be better for condemnation, but <br />Commissioner Bird pointed out that this property is a key parcel <br />because it lies between two other county -owned parcels. He <br />really didn't know of any other parcel in that area to submit to <br />the State. <br />Commissioner Lyons was of the impression that the Motion <br />only instructs staff to take another look at the beach study, but <br />Attorney Vitunac emphasized that he needs an indication from the <br />Board by formal Motion that we can send a letter to the State <br />saying that the Board of County Commissioners has determined to <br />acquire this piece of property by any legal means.
