RESOLUTION NO. 2015 - <br />WHEREAS, the Florida Municipal Power Agency's All Requirements Project <br />agreement to curtail peak -shaving activities are primarily voluntary, rely on self -reporting, and <br />contain no penalties for noncompliance, and <br />WHEREAS, certain of the All Requirements Project contract provisions relating to <br />withdrawing members are ambiguous, use a fixed discount rate rather than one based on current <br />capital costs, and do not provide for independent verification by a withdrawing member, and <br />WHEREAS, even though the Florida Municipal Power Agency isa,governmental entity, <br />manyof the laws that apply to localgovernments do not 1 to the agency, and <br />pP Y apply g Y� <br />WHEREAS, the Florida Municipal Power Agency isnot subject to any rate-setting <br />authority, including the Public Service Commission, and <br />WHEREAS, elected officials who support; transparency and `'acco.untability in <br />government, including governmental agencies, serve,.their constituencies well; and <br />WHEREAS, elected officials have a fiduciary day <br />value of the assets and liabilities for which they are responsi <br />ty=4o.::those they serve to understand the <br />WHEREAS, House Bill 579 has been:=intr•,oduced to promote ,:transparency, consistency, <br />and public understanding and confidence in.{ thesoperation of the" Florida Municipal Power <br />t.Agency by the member municipalities and therpublic,incl"udi°ng-those electric ratepayers who are <br />t�., fir. t•�., <br />not residents of the municipality,supplying electriclpower but=who are subject to a municipality <br />that is receiving power fronai°the="Flo ida Municipai,Power Agency, <br />NOW, THEREEW, BO' IT RESOLVrED BY THE BOARD OF COUNTY <br />� <br />COMMISSIONERS OF INDIANr RhVER COUNTY, FLORIDA, THAT: <br />Section=l'"�Tle -boye "WHEREAS" clauses are true and correct, and are hereby adopted <br />as findings`o�'t -- Board. <br />_d .. , :..:=n. <br />r� sn <br />47 <br />Seetiont2.
