DeBraal, Deputy County Attorney <br />DATE: November 10, 2015 <br />SUBJECT: Revised Temporary Construction Easement for 45th Street Beautification Project <br />At its meeting of August 18, 2015, the Board approved a Temporary Construction Easement for <br />landscaping improvements to be made at Gifford Middle School as part of the 45th Street <br />Beautification Project. The Chairman signed the easement and staff forwarded the document on to <br />the School Board for approval and signature. After the BCC approved the easement but before it <br />was approved by the School Board, it was discovered that the legal description of the easement <br />needed to be adjusted slightly. The School Board approved the easement with the revised legal <br />description and sent it back to the BCC for approval of the easement with the revised legal <br />description. <br />Landscaping will be installed along the south side of the school on property owned by the School <br />Board of Indian River County. After the contractor's warranty period ends, the School District has <br />agreed to incorporate maintenance of plantings in their regular schedule of lawn and landscaping <br />care at the Middle School. <br />FUNDING. There is no funding associated with this matter as the document will not be recorded. <br />RECOMMENDATION. Staff recommends the Board approve the Temporary Construction <br />Easement Deed with the revised legal description for the installation of landscaping on the south <br />side of Gifford Middle School in association with the 45th Street Beautification Project and authorize <br />the Chairman to execute the Acceptance of Conveyance of the easement on behalf of the Board. <br />cc: Phil Matson <br />Indian River Co. <br />Admin. <br />Co.
