A R R. 16 1986 BOOK 64 P";r <br />182 <br />Chairman Scurlock stated his suggestion would be that we be <br />paid immediately for those 27 trees, and then escrow the balance <br />until the remaining facility is constructed. <br />Attorney Vitunac noted that if the project is abandoned <br />before completion, the money then would be used to replant the <br />trees. <br />Planner Challacombe informed the Board that one of staff's <br />primary concerns at this point is wind erosion at the site. We <br />need to have some kind of stabilization to preserve the site and <br />eliminate some problems, and he recommended seeding and mulching <br />bahia grass to stabilize. <br />MOTION WAS MADE by Commissioner Lyons, SECONDED by <br />Commissioner Wodtke, to ask the respondent for an <br />immediate contribution for the 27 trees or $13,500 <br />and to escrow the remainder of the $52,500 fine <br />($39,000) until such time as the project is completed <br />or is abandoned and to provide proper stabilization <br />of the site as quickly as possible. <br />Commissioner Bowman stressed that the area involved is a <br />pristine area, which is very important to the geology of the <br />county, and we are dealing with something that will not grow <br />anywhere else. She believed the respondent should at least be <br />required to purchase another such pristine area and donate it to <br />the county because the Motion doesn't save anything of what was <br />destroyed. <br />Commissioner Lyons noted that we can use the money to <br />purchase such land, and Commissioner Wodkte pointed out that the <br />money placed in escrow also would be released based on the <br />development plan and how it progressed. <br />Attorney Vitunac emphasized that we should have a time limit <br />re the development schedule, and after discussion it was agreed <br />to set a limit of seven years. <br />46 <br />
