Heath R/E Sousa <br />FROM: Code Enforcement Officer REFERENCES: DIS : REMS <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of April 16, 1986. <br />DESCRIPTION AND CONDITIONS: <br />The County has been petitioned by Douglas Sousa, and Catherine <br />Sousa, his wife, owners of the subject property, for the release <br />of the side lot utility easements of Lots 8 & 9, Seminole <br />Shores Subdivision, being the westerly five (5) feet of Lot 8, <br />and the easterly five (5) feet of Lot 9, Section 28, Township <br />33 South, Range 40, as recorded in Plat Book 542, Page 19, of <br />the Public Records of Indian River County, Florida. It is the <br />Sousa's intention to consolidate these lots into one large <br />building site meeting the requirements of the RS -3 zoning <br />district and construct a single-family residence on the site. <br />The current zoning classification is RS -3, Single -Family <br />Residential District. The land use designation is LD -1, Low <br />Density Residential, up to three (3) units per acre. <br />ALTERNATIVES AND ANALYSIS: <br />The request has been reviewed by Southern Bell, Vero Beach <br />power company, Florida Cablevision Corporation, and Indian <br />River County Utility and Right -of -Way Departments. Based upon <br />their review, there were no objections to the release of the <br />easements. The zoning staff analysis, which included a site <br />visit, showed that drainage would be adequately handled <br />on-site. <br />RECOMMENDATION: <br />Staff recommends to the Board, through adoption of a resolution, <br />the release of the common five (5) foot side lot easements of <br />Lots 8 & 9, Seminole Shores Subdivision, being the westerly <br />five (5) feet of Lot 8, and the easterly five (5) feet of Lot <br />9, Seminole Shores Subdivision, as recorded in Plat Book 542, <br />Page 19, of the Public Records of Indian River County, Florida. <br />ON MOTION by Commissioner Lyons, SECONDED by Com- <br />missioner Wodtke, the Board unanimously approved <br />Resolution 86-18 releasing the ten foot utility <br />and drainage easement between Lots 8 & 9, Seminole <br />Shores Subdivision, as requested by Douglas Sousa. <br />8 <br />
