APR 2 3 1996 BOOK 6 4 F,�F 2S <br />Art Challacombe, Chief of Environmental Planning, explained <br />that if application for a permit had been made before the trees <br />were removed, staff actually would have authorized removal of all <br />those trees, even the 3 protected hickory trees which were in the <br />buildable area of the lot. He admitted that there are some <br />mitigating circumstances in this particular case. Mr. Mitchell <br />already has paid $80, which is twice the normal amount charged <br />for a tree clearing permit, but staff wishes him to pay an <br />additional $100 for removing the three protected hickory trees. <br />Commissioner Bowman asked why we don't automatically charge <br />more for an after -the -fact permit, and Chairman Scurlock <br />suggested writing it into the ordinance that if they come in for <br />a permit after the fact that it is going to cost them 3 times the <br />normal amount. <br />Mr. Challacombe stated that during the workshop on the Tree <br />Protection Ordinance last week, there were some gray areas <br />defined that we could make clearer. <br />Commissioner Bird understood that Mr. Mitchell has agreed to <br />the pay the additional $100 which would be for 3 protected trees <br />that were removed, and that $100 is in addition to the $80 for <br />the after -the -fact permit. <br />MOTION WAS MADE by Commissioner Lyons, SECONDED <br />by Commissioner Wodtke, that the Board accept the <br />voluntary payment of $100 by Ron Mitchell. <br />Commissioner Bowman felt that we are getting very soft with <br />these tree clearing violations and that the word is getting <br />around that the Board will let them off easy if they come in with <br />a good excuse. <br />THE CHAIRMAN CALLED FOR THE QUESTION. The Motion <br />was voted on and carried by a vote of 4-1, Commissioner <br />Bowman dissenting. <br />46 <br />
