McCoy, A CP; Chief, Current Development <br />Ryan Sweeney; Senior Planner, Current Development <br />December 4, 2015 <br />SUBJECT: Ron Taylor's Request for Abandonment of a Portion of a 30' Wide Right -of -Way <br />Lying South of Lot 5, Block B of the Green Acres Estates Subdivision [ROW -15-07- <br />01 / 98020174-74697] <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of December 15, 2015. <br />DESCRIPTION AND CONDITIONS: <br />Ron Taylor is requesting abandonment of a portion of a 30' wide right-of-way lying south of Lot 5, <br />Block B of the Green Acres Estates subdivision. The subject portion of right-of-way has never been <br />formally improved for vehicular use, but does currently contain existing drainage and utility <br />improvements (drainage swale, power poles, and overhead utility lines). Those improvements will <br />remain "as -is", and will be protected by retaining drainage and utility easements over appropriate <br />areas of the right-of-way. <br />Currently, the applicant owns the abutting lot (lot 5 of block B of the Tropical Village Estates <br />subdivision), and the subject abandonment request includes only that portion of the existing right-of- <br />way that immediately abuts the applicant's lot. The original abandonment request included the <br />portion of right-of-way lying south of lot 5 of Block C (west side of 47t Avenue SW); however, the <br />request has since been modified to include only the portion that immediately abuts the applicant's <br />lot. No other property owner will be affected by the proposed abandonment, as the applicant <br />currently owns the only abutting lot. If abandoned, the entire subject portion of right-of-way will be <br />joined to the adjacent private lot (lot 5) within block B of the Green Acres Estates subdivision, since <br />the right-of-way was created by the Green Acres Estates plat. <br />As required by the County land development regulations (LDRs), prior to the Technical Review <br />Committee (TRC) meeting at which the subject application was reviewed, staff notified by mail each <br />property owner adjacent to the subject right-of-way.
