Director Pinto explained that we will just hold the CO's <br />and, where appropriate, building permits until the funds are <br />deposited. In some cases such as the shopping center, we will <br />have to make an estimate and then after they actually occupy, we <br />will have to go back and audit to determine the actual uses. <br />Commissioner Wodtke asked why the deposit should be changed <br />to the time of the building permit rather than the CO, and <br />Utilities Director Pinto noted that builders are always reason- <br />able before they get their building permit, but once they get <br />their building up, they have a lot of money tied up. Also, all <br />our other impact fees are collected at the time of building <br />permits; this is the only fee that isn't. <br />Henry Muller, developer, noted that he is delinquent but not <br />in any astronomical amount. He advised that they pay automatic- <br />ally on each sale of a condo, which actually is not the way the <br />franchise reads. He has paid for about half the building, which <br />is half sold, and he would like to be able to continue this way <br />for that building. Mr. Muller believed this should be looked at <br />in another way because the anxiety to get the money is not tied <br />to the need to spend the money, which may not be used for some <br />time, if ever. He did not disagree with anything Mr. Pinto has <br />said other than collecting these funds at the time of the <br />building permit. Mr. Muller emphasized that he wants to go by <br />the rules, but he doesn't want to be the only one going by the <br />rules. He also stressed that he doesn't want to be in the <br />utility business and would just as soon have the County take his <br />plant over tomorrow, operate it, and charge him the fees. <br />Attorney Vitunac noted that Director Pinto mentioned it was <br />a mistake to let the interest go back to the developers. He felt <br />if the developers who are in arrears want some relief, now is a <br />good bargaining time to rewrite their franchise and put the <br />interest where it belongs. <br />Director Pinto emphasized that right now the most important <br />thing is to allow staff to proceed with whatever is necessary to <br />79 <br />MAY 7 1986BOOK 6���;F6 <br />
