Attorney Barkett advised that we have not been able to get <br />title insurance on the lot, and it can be used only as a utility <br />right-of-way unless we purchase it from The Moorings. <br />Chairman Scurlock did not feel they would want a bridge <br />going through there; he believed that lot would sell for more <br />than $170,000 and felt they should sell it and split the money. <br />Commissioner Wodtke felt it is apparent we are not going to <br />need it for a bridge, and he favored taking their offer. The <br />Administrator concurred. <br />Chairman Scurlock then suggested that the County pay The <br />Moorings $60,000 for the lot, and Attorney Hudson stated that she <br />could take that offer back, but noted one of the provisions of <br />their purchase is that they be allowed to build a duplex on the <br />property. <br />Commissioner Bird asked if in accepting their offer we would <br />be giving them permission to put in a duplex, and Attorney <br />Barkett stated that he could not recommend that because it would <br />deviate from the Comprehensive Plan. <br />Commissioner Wodtke felt it should be simple to check out if <br />the requirements for building a duplex can be met before we reach <br />a final decision, but Attorney Vitunac noted The Moorings wants <br />us to guarantee they can build a duplex, and he did not believe <br />we can do that legally. <br />Discussion continued at length while the Board continued to <br />review various alternatives, including making a counter-offer. <br />ON MOTION by Commissioner Wodtke, SECONDED by <br />Commissioner Bird, Chairman Scurlock voting in <br />opposition, the Board by a 4 to 1 vote agreed <br />to make The Moorings a counter-offer accepting <br />their offer of $60,000 for the lot but with <br />no guaranty as to the use of the land. <br />89 <br />MAY 7 1986 pool; 'd FAr,F375 <br />
