�y <br />t <br />RESOLUTION NO. 2016- 015 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, FORMALLY ACCEPTING THE DEDICATION <br />OF STREETS SHOWN ON THE OCEANSIDE REPLAT <br />SUBDIVISION PURSUANT TO CHAPTER 177, PART 1, <br />FLORIDA STATUTES. <br />WHEREAS, Oceanside Replat Subdivision (Oceanside) was replatted as a <br />subdivision in 1979 and Is located on the south barrier island in the unincorporated area <br />of the County; and <br />WHEREAS, at the time Oceanside was replatted, no formal property or <br />homeowner's association was created, thus the streets were not formally dedicated to <br />an entity for maintenance purposes but the replat declared them to be private; and <br />WHEREAS, the property owners residing in Oceanside have requested the <br />County to formally take over their streets and establish a mechanism to have the streets <br />repaved and for the County to assume maintenance of the streets; and <br />WHEREAS, on July 14, 2015, the Board of County Commissioners of Indian <br />River County approved Ordinance No 2015-008 which established a Municipal <br />Services Benefit Unit (MSBU) that imposed a non ad valorem assessment on property <br />owners in Oceanside to pay for the cost of street repaving that will be performed by the <br />County, and <br />WHEREAS, the MSBU will collect assessments from the Oceanside property <br />owners for five years and the County will use those funds to repave the Oceanside <br />streets; and <br />WHEREAS, the dedication on the Oceanside Replat states, in part, as follows: <br />"Treasure Coast Development, a general partnership, the Owner and <br />Developer.... does hereby dedicate this plat of the subdivision of its lands <br />as shown thereon as follows: <br />E. The easements for public utility and cable vision purposes, and the <br />streets shown hereon as Captains Walk, Waltons Court, Sanford Court, <br />Whispering Sands Lane and that part of Reef Road within this plat, for the <br />use of the property owner's in this subdivision with the full knowledge that <br />the same are not dedicated to the public until there is a formal <br />acceptance of these streets and/or easements or any part thereof by <br />the County Commission for Indian River County, Florida. <br />3120160008100 <br />RECORDED IN THE PUBLIC RECORDS OF <br />JEFFREY R SMITH, CLERK OF COURT <br />INDIAN RIVER COUNTY FL <br />1 BK. 2911 PG: 1204 Page 1 of 4 2/11/2016 3:35 PM <br />
