If the Federal <br /> award meets the definition of"funding agreement"under 37 CFR 401.2(a) and the recipient <br /> or Subrecipient wishes to enter into a contract with a small business firm or nonprofit <br /> organization regarding the substitution of parties, assignment or performance of <br /> experimental, developmental, or research work under the"funding agreement,"the recipient <br /> or subrecipient must comply with the requirements of 37 CFR Part 401,"Rights to Inventions <br /> Made by Nonprofit Organizations and Small Business Firms Under Government Grants, <br /> Contracts and Cooperative Agreements," and any implementing regulations issued by the <br /> awarding agency. Appendix lI, OMB Uniform Guidance (2 CFR 200). <br /> A. Clean Air Act and Water Pollution Control Act. All applicable standards, orders, or <br /> requirements issued under the Clean Air Act (42 U.S.C. 7401-7671q), and the Water <br /> Pollution Control Act (33 U.S.C. 1251-1387, as amended). Appendix H, OMB Uniform <br /> Guidance (2 CFR 200). <br /> vu. Energy Efficiency. Mandatory standards and policies relating to energy efficiency which <br /> are contained in the State energy conservation plan issued in compliance with the Energy <br /> Policy and Conservation Act (Pub. L. 94-163, 89 Stat. 871). Appendix II, OMB Uniform <br /> Guidance(2 CFR 200). <br /> viii. Drug-Free Workplace. Pursuant to the Drug-Free Workplace Act of 1988, and its <br /> implementing regulations codified at 29 CFR Part 94, the Grantee will provide a drug-free <br /> workplace. <br /> ix. Trafficking Victims Protection Act of 2000. This federal award is subject to the <br /> Trafficking Victims Protection Act of 2000,as amended(22 U.S.C. 7104(g),2 CFR 175.15). <br /> As such, the awarding federal agency may unilaterally terminate this award without penalty <br /> for violations of this Act. If any recipient, subrecipient, contractor or subcontractor under <br /> this grant is a private entity,the following provision applies to the federal award: <br /> 1. You as the recipient, your employees, subrecipients under this award, and subrecipients' <br /> employees may not— <br /> a. Engage in severe forms of trafficking in persons during the period of time <br /> that the award is in effect; <br /> b. Procure a commercial sex act during the period of time that the award is in <br /> effect; or <br /> c. Use forced labor in the performance of the award or subawards under the <br /> award. <br /> X. Debarment and Suspension. <br /> 1. Grantee Federal Certification. In accordance with Federal Executive Order 12549, <br /> Debarment and Suspension,the Grantee shall agree and certify that neither it,nor its <br /> principals, is presently debarred, suspended, proposed for debarment, declared <br /> ineligible, or voluntarily excluded from participation in this transaction by any <br /> federal department or agency; and, that the Grantee shall not knowingly enter into <br /> any lower tier agreement,or other covered transaction,with a person who is similarly <br /> debarred or suspended from participating in this covered transaction. <br /> GRANT -GOVERNMENTAL ENTITY Ver.
