<br /> If this Agreement is supported by Federal funding,
<br /> then the following Certifications and Assurances apply.
<br /> A. Equal Employment Opportunity. Grantee certifies that to the best of its knowledge, it, its
<br /> principals, agents,recipients, subrecipients,,contractors and subcontractors, are in compliance with the
<br /> Equal Employment Opportunity requirements contained in Executive Order 11246 of September 24,
<br /> 1965, entitled "Equal Employment Opportunity," as amended by Executive Order 11375 of October
<br /> 13, 1967, and as supplemented in Department of Labor regulations (41 CFR Chapter 60).
<br /> B. Davis-Bacon Act. Grantee certifies that to the best of its knowledge, it, its principals, agents,
<br /> recipients, subrecipients, contractors and subcontractors, are in compliance with the Davis-Bacon Act
<br /> 40 U.S.C. 3141-3148, as supplemented by Department of Labor regulations at 29 CFR Part 5.
<br /> C. Copeland"Anti-Kickback Act. Grantee certifies that to the best of its knowledge, it,its principals,
<br /> agents, recipients, subrecipients, contractors and subcontractors, are in compliance with the Copeland
<br /> "Anti-Kickback"Act,40 U.S.C. 3141-3148,and 3146-3148,as supplemented by Department of Labor
<br /> regulations (29 CFR Part 5).
<br /> D. Contract Work Hours and Safety Standards Act. Grantee certifies that to the best of its
<br /> knowledge, it, its principals, agents, recipients, subrecipients, contractors and subcontractors, are in
<br /> compliance with the Contract Work House and Safety Standards Act, Sections 103 and 107 of the
<br /> Agreement Work Hours and Safety Standards Act (40 U.S.C. 3702 and 3704) as supplemented by
<br /> Department of Labor regulations(29 CFR part 5).
<br /> E. Rights to Inventions Made Under a Contract or Agreement. Grantee assures that it, its principals,
<br /> agents, recipients, subrecipients, contractors and subcontractors, will comply with the requirements of
<br /> the "Rights to Inventions Made by Nonprofit Organizations and Small Business Firms Under
<br /> Government Grants, Contracts and Cooperative Agreements", 37 CFR Part 401.
<br /> F. Clean Air Act and Water Pollution Control Act. Grantee assures that it, its principals, agents,
<br /> recipients, subrecipients, contractors and subcontractors, will comply with the requirements of the
<br /> Clean An-Act, 42 U S.C. 7401-7671q, and the Water Pollution Control Act, 33 U.S.C. 1251-1387, as
<br /> amended.
<br /> G. Energy Efficiency. Grantee assures that it, its principals, agents,recipients, subrecipients, contractors
<br /> and subcontractors,will comply with the requirements of the mandatory standards and policies relating
<br /> to energy efficiency which are contained in the State energy conservation plan issued in compliance
<br /> with the Energy Policy and Conservation Act,Pub. L. 94-163, 89 Stat. 871.
<br /> H. Drug-Free Workplace. Grantee assures that it, its principals, agents, recipients, subrecipients,
<br /> contractors and subcontractors, will comply with the requirements of the Drug-Free Workplace Act of
<br /> 1988, and its implementing regulations codified at 29 CFR Part 94.
<br /> a. Pursuant to the Drug-Free Workplace Act of 1988,the undersigned attests and certifies that the
<br /> Grantee(if not an individual) will provide a drug-free workplace by the following actions:
<br /> 1. Publishing a statement notifying employees that the unlawful manufacture, distribution,
<br /> dispensing,possession or use of a controlled substance is prohibited in Grantee's workplace
<br /> and specifying the actions that will be taken against employees for violation of such
<br /> prohibition.
