MAY 14 1986 BOOK 64 PAG- 418 <br />Chairman Scurlock explained that Mr. White would like to put <br />a TV satellite dish in his back yard, but does not really have a <br />back yard. Both of his yards are defined as front yards as he <br />lives on a lot that extends from one street on through to the <br />next street and TV dishes are not allowed in side yards. <br />Chairman Scurlock asked the Board to consider directing <br />staff to modify the ordinance to redefine a front yard so that we <br />have some reasonableness without putting somebody through the <br />variance process. <br />Robert Keating, Director of Planning & Development, <br />explained that staff suggested that this be done through the <br />variance process, because in situations like this where there are <br />different frontages, you almost have to Look at it on a case by <br />case basis. <br />Chairman Scurlock felt that was not the case here since all <br />the homes face the same way and have mailboxes in what they <br />believe to be their front yards. <br />Administrator Wright objected to staff preparing a blanket <br />type ordinance, but Chairman Scurlock felt we need to have <br />something. in our ordinances for new development to identify the <br />front yard from the back yard. <br />Administrator Wright suggested that staff be instructed to <br />go back and address the problem, and perhaps bring back a <br />recommendation to handle these cases by administrative approval. <br />Chairman Scurlock was not sure that the Board of Adjustments <br />has the ability to grant this type of a variance, but Attorney <br />Vitunac stated they do have the power to look at unique shapes of <br />property. <br />Commissioner Lyons wished to see this type of situation <br />handled administratively. <br />Commissioner Wodtke asked how fast this could be done, and <br />Director Keating explained that staff could bring a general <br />proposal back to the Board in possibly two weeks, and then go <br />through the process to amend an ordinance. <br />18 <br />
