Under discussion, Commissioner Wodtke stated that based on <br />the results, he even would be willing to have the County pursue <br />with the individual homeowners whatever legal action is necessary <br />against the developer of Village Green to see that the <br />corrections are made at the developer's cost. <br />Chairman Scurlock asked Attorney Vitunac if we have the <br />ability to make the repairs and put a lien on the mobile home <br />park, but Attorney Vitunac did not believe we could at this time. <br />Staff has discussed this at great length, as well as with the <br />homeowners, and find that this is not a common problem to every <br />lot. Some people made their improvements after they had moved in <br />and no inspections were ever made. In addition, they have <br />separate contracts.with the developer and it would be a very <br />complicated suit. The County's interest is to -see that no one <br />gets killed out there by an electrical malfunction and that is <br />the reason for staff's recommendation that a certified letter be <br />sent to every homeowner offering them an inspection. <br />Attorney Vitunac advised that he had suggested to the home <br />owners that they could file a class action suit with attorneys <br />who would take their fees on a contingency basis. <br />Mark Allison, resident of Village Green, advised that the <br />residents were interested in pursuing this legally, but the <br />drawback was the legal fees involved. He wondered about the <br />liability in the case of a contracted electrician was inj-ured <br />crawling under the mobile unit. <br />Commissioner Lyons felt that since we have been told there <br />are life-threatening electrical hazards in many of the units in <br />Village Green, the County Commission has the responsibility to <br />find out whether this is true or not. He felt that this is the <br />first step we must taken. <br />Commissioner Bird agreed that once the units are inspected, <br />it would give us a handle on the magnitude of the problem. <br />45 <br />MAYBOOK 64 f":�E 445 <br />14 1986 <br />
