SAY 2 1 196 BOOK 61 F,�a 531 <br />Eugene Popow, president of the corporation which manages <br />Oyster Bay and Oyster Pointe, confirmed that their insurance <br />situation is very difficult. It has been solved in all areas but <br />windstorm damage. If the area west of the river could be the <br />same designation as the barrier island, they would be able to get <br />the insurance and could participate in the insurance pool and <br />their premiums would be about 1/8 of what they are. <br />Attorney Vitunac commented that Merrill Lynch is requesting <br />that the County hold a public hearing, but the law provides that <br />the Department of Insurance holds the hearing. <br />Ms. Carolyn Miller advised that the State says they don't <br />hold the hearing; they will attend it. <br />Discussion ensured re the area to be included, and it was <br />felt we should make it border to border so we can have windstorm <br />insurance for all of our county. <br />ON MOTION by Commissioner Wodtke, SECONDED by <br />Commissioner Bird, the Board unanimously (4-0) <br />authorized the County Attorney to delve into <br />this and set up a public hearing in regard to <br />meeting the requirements for windstorm insurance <br />for the entire area west of the river. <br />ESTABLISH BASE LINE ELEVATION FROM WHICH MAXIMUM BUILDING HEIGHT <br />IS TO BE MEASURED (NUTT) <br />Attorney William Stewart came before the Board representing <br />Gordon Nutt, owner and developer of the Turtle Back Beach Resort. <br />He stated that since their last appearance before the Commission, <br />Mr.. Nutt and architects have been working diligently on getting <br />the project moving along towards completion at the earliest <br />possible time although they have had to deal with a number of <br />unanticipated issues which have delayed them, such as coastal <br />construction setback, and they are now stymied with a problem as <br />to how to measure the height of the buildings on this project. <br />74 <br />
