ORDINANCE NO. 2016-_M2 <br />AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, AMENDING SECTION 1100.04 <br />(DEFINITIONS OF TERMS) OF CHAPTER 1100 (ECONOMIC DEVELOPMENT <br />AD VALOREM TAX EXEMPTION) OF THE CODE OF INDIAN RIVER COUNTY <br />TO REMOVE REFERENCES TO THE ENTERPRISE ZONE; AND PROVIDING <br />FOR CODIFICATION, SEVERABILITY, REPEAL OF CONFLICTING <br />PROVISIONS, AND AN EFFECTIVE DATE. <br />WHEREAS, per Section 290.016, Florida Statutes, the Florida Enterprise Zone Act was <br />repealed on December 31, 2015; and <br />WHEREAS, once the Florida Enterprise Zone Act expired then local governments were <br />no longer permitted to authorize tax exemptions for business in the enterprise zone, unless the <br />business qualified as some other form of new business or expansion of an existing business <br />under the statute; and <br />WHEREAS, in order to be consistent with the Florida Statutes, Chapter 1100, Economic <br />Development Ad Valorem Tax Exemption, of the Code of Indian River County needs to be <br />amended to remove references to the Enterprise Zone, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA THAT: <br />Section 1. Enactment Authoritv. <br />Article VIII, section 1 of the Florida Constitution and chapter 125, Florida Statutes vest broad <br />home rule powers in counties to enact ordinances, not inconsistent with general or special law, <br />for the purpose of protecting the public health, safety and welfare of the residents of the county. <br />The Board specifically determines that the enactment of this ordinance is necessary to protect <br />the health, safety and welfare of the residents of Indian River County. <br />Section 2. Legislative Findings. <br />The Board finds that the "Whereas" clauses above are true and correct, and hereby <br />incorporates such clauses as the legislative findings of the Board. <br />Section 3. Amendment of Section 1100.04 (Definitions of Terms) of Chapter 1100 <br />(Economic Development Ad Valorem Tax Exemption). <br />New language indicated by underline, and deleted language indicated by <br />
