Concessionaire Contract. If the Concessionaire seeks or is subject to a judicial determination <br />as to the scope of records required to be disclosed under Chapter 119, F.S. and such judicial <br />determination is sought or defended by the Concessionaire in good faith, the Concessionaire <br />shall abide by the judicial determination and, in such a case, shall not be considered to have <br />breached the Concessionaire Contract. <br />NO THIRD PARTY BENEFICIARIP <br />This Contract in no way affords to any third party legal benefits or otherwise the ability <br />to enforce provisions of this Contract. <br />NON-DISCRIMINATION <br />As a condition of this agreement, the Concessionaire hereby covenants and agrees not <br />to discriminate against any individual because of that individual's race, color, religion, sex, <br />national origin, age, handicap, or marital status with respect to any activity occurring pursuant <br />to this agreement. <br />UNAUTHORIZED ALIEN WORKERS <br />In accordance with Executive Order 96-236, the Commission shall consider the <br />employment by any Concessionaire of unauthorized aliens a violation of section 274A(e) of the <br />Immigration and Nationalization Act. Such violation shall be cause for unilateral cancellation <br />of this Contract, if the Concessionaire knowingly employees unauthorized aliens. <br />PUBLIC ENTITY CRIMES <br />In accordance with §287.133(2)(a), Florida Statutes, a person or -affiliate who has been <br />placed on the convicted vendor list following a conviction for a public entity crime may not <br />submit a bid on a Contract to provide any goods or services to a public entity, may not submit <br />a bid on a Contract with a public entity for the construction or repair of a public entity or a <br />public work, may not submit bids on leases of real property to a public entity, may not be <br />awarded or perform work as a contractor, supplier, subcontractor; or consultant under a <br />contractor with any public entity, and may not transact business with any public entity in <br />access of the threshold amount provided in §287.017, Florida Statutes, for CATEGORY II for <br />a period of 36 months from the date of being placed on the convicted vendor list. <br />JURY TRLAL WAIVER <br />The parties hereto, for the considerations herein, expressly waive the right of jury trial <br />in any legal or equitable matters stemming from this Concessionaire contract. <br />13 <br />.59 <br />
