15, A final Form HUD 2880, if required, shall be provided to the Department with the <br /> request for administrative closeout, and its absence or incompleteness shall be <br /> cause for rejection of the administrative closeout. <br /> 16. Conflicts of interest relating to procurement shall be addressed pursuant to 24 <br /> CFR 570.489(8). Conflicts of interest relating to acquisition or disposition of real <br /> property; NSP financial assistance to beneficiaries, businesses, or other third <br /> parties; or any other financial interest, whether real or perceived, shall be <br /> addressed pursuant to 24 CFR. 570.489(h). <br /> 17, The Recipient shall take photographs or video of all activity locations prior to <br /> initiating any NSP-assisted activity. As the construction progresses, additional <br /> photography or videography shall document the ongoing improvements. Upon <br /> completion of construction, final documentation of the activity locations will be <br /> provided to the Department with the administrative closeout package. <br /> 18. If an activity is designed by an engineer, architect, or other licensed professional, <br /> it shall be certified upon completion by a licensed professional as meeting the <br /> specifications of the design, as may have been amended by change orders, The <br /> date of completion of construction shall be noted as part of the certification, This <br /> certification shall be accomplished prior to submission of an administrative <br /> closeout package, and a copy of the certification shall be submitted with the <br /> administrative closeout package. <br /> 19. The Recipient warrants that it possesses the legal authority to carry out the <br /> programs for which it is seeking funding, in accordance with applicable HUD <br /> regulations and other program requirements. <br /> 20. The Recipient shall comply with section 3 of the Housing and Urban <br /> Development Act of 1968 (12 U.S.C. 1701u), and implementing regulations at 24 <br /> CFR Part 135. <br /> 21, The Recipient will comply with the requirement that all of the NSP funds made <br /> available to it will be used with respect to individuals and families whose incomes <br /> do not exceed 120 percent of area median income, All funds allocated to assist <br /> the NSP Low-Income (NSPLI) target population must be used to provide rental <br /> housing for those individuals and families whose incomes do not exceed 50 <br /> percent of area median income. <br /> 22, The Recipient will not attempt to recover any capital costs of public <br /> improvements assisted with CDBG funds, including Section 108 loan guaranteed <br /> funds, by assessing such costs against properties owned and occupied by persons <br /> of low- or moderate-income. No fee may be charged or assessed as a condition of <br /> obtaining access to such public improvements.
