29, Recipient shall warrant and assure that no entity receiving NSP funds has <br /> unresolved findings that were raised as a result of any Department or HUD audit, <br /> management review, or other government investigation concerning the entity, its <br /> developments, or contracts. <br /> 30. Recipient shall warrant and assure that no entity receiving NSP funds has been in <br /> breach of any agreement relating to construction, rehabilitation, use, operation, <br /> management, or disposition of real property, or had payments suspended or <br /> terminated under any state or federal assistance contract. <br /> 31. The Department reserves the right to require the Recipient to contract with a third <br /> party management or accounting entity to audit any or all real estate and financial <br /> transactions involving NSP funds. <br /> Use of Third Party Entities <br /> 1. Before disbursing any NSP funds to any entity, the Recipient must enter into a <br /> written agreement with that entity. Before disbursing any NSP funds to any entity, <br /> the Recipient must either directly or indirectly oversee the execution of written <br /> agreements with that entity, including sub-recipients, contractors, and property <br /> owners, that ensure the proper use of funds and compliance with applicable <br /> regulations. Sub-recipients must also enter into,or oversee the execution of, <br /> written agreements with or between any contractors, property owners, or other <br /> entities, prior to disbursing NSP funds. <br /> 2, The Recipient shall monitor the day-to-day operations of sub-recipient activities <br /> to assure compliance with applicable Federal requirements and performance <br /> goals. Recipient monitoring must cover each NSP strategy,function,or activity. <br /> Housing Rehabilitation Standards <br /> 1. The Recipient shall provide assistance for the rehabilitation of housing in a <br /> floodplain only after documenting in the rehabilitation case file for that structure <br /> that the Recipient and the beneficiary are in compliance with the Flood Disaster <br /> Protection Act of 1973, This documentation must address, at a minimum, <br /> elevation requirements, erosion, and water, sewage, or septic tank requirements. <br /> Each structure located within a floodplain that is rehabilitated to any extent with <br /> NSP funds shall be insured under the National Flood Insurance Program until at <br /> least submission of the administrative closeout package. <br /> 2, The Recipient must comply with the NSP Housing Assistance Plan (HAP) that <br /> was provided to the Department as part of the application process, The Recipient <br /> agrees that this Housing Assistance Plan will be followed unless waived by the <br /> local governing body and approved by the Department.
