Work & Purpose: The applicant proposes to construct <br />private single 4' x 40' marginal docks with 30' x 81• <br />observation decks (500 square feet) for each of the <br />aforementioned lots. No sewage pump -out or fueling <br />facilities are proposed. No dredging or filling will be <br />performed. <br />ALTERNATIVES & ANALYSIS: <br />The Planning and Development Division reviews and submits <br />comments on dredge and fill applications to the permitting <br />agencies based upon the following: <br />The Conservation & Coastal Zoning Management Element of <br />the Indian River Comprehensive Plan <br />- Coastal Zone Management, Interim Goals, Objectives & <br />Policies for the Treasure Coast Region <br />The Hutchinson Island Planning & Management Plan <br />The Indian River County Code of Laws and Ordinances <br />All of the five projects are located in the City of Vero Beach. <br />Therefore, the focus of staff review is on potential County and <br />regional impacts rather than site-specific impacts; in-depth <br />field inspections of the project sites were not. conducted. <br />Chapter 16Q-20 of the Florida Administrative Code sets para- <br />meters for private residential single docks located in the <br />Indian River Aquatic Preserve. Section 16Q -20.04(5)(b), <br />Florida Administrative Code, sets forth specific design stan- <br />dards and criteria for private single docks. <br />Although the extent of any impacts are not fully known at this <br />time, there may be cumulative impacts of these and other <br />dockage projects proposed to be constructed along the Indian, <br />River upon the Florida Manatee. <br />RECOMMENDATION: <br />It is recommended that the Board of County Commissioners <br />authorize staff to forward the following comments regarding <br />these projects to the Florida Department of Environmental <br />Regulation: <br />1) The Department of Environmental REgulation and other <br />appropriate agencies should coordinate with the D.N.R. to <br />determine if the proposed projects are located in the <br />Indian River Aquatic Preserve and therefore subject to <br />requirements of Chapter 16Q-20, Florida Administrative <br />Code; <br />2) The Department of Environmental Regulation and other <br />appropriate agencies should consider the potential cumula- <br />tive impacts of dockage projects upon the Florida Manatee; <br />3) The Department of Environmental Regulation and other <br />appropriate agencies should evaluate the potential impact <br />of marina projects on ecologically significant- submerged <br />bottomlands such as seagrass beds in the Indian River. <br />5 BOOK 64 PACE 667 <br />0 <br />
