DeBlois, AICP_AP <br />Chief, Environmental Planning <br />& Code Enforcement <br />DATE: February 8, 2016 <br />RE: Board Consideration of an Unauthorized Dock on County -Owned Shoreline Property <br />West of Morningside Drive on South Jungle Trail <br />It is requested that the Board of County Commissioners formally consider the following information at <br />its regular meeting of February 16, 2016. <br />DESCRIPTION AND CONDITIONS <br />Morningside Drive is a dead-end road accessed off Jungle Trail, located south of the Jones's Pier <br />Conservation Area (7770 Jungle Trail) by approximately ±321 feet. The road was platted in 1958 as a <br />part of Riverside Estates (see Attachment 2), a 22 lot single-family residential subdivision that is <br />currently developed with 14 residences. Two of the subdivision lots (ownership parcels) have Jungle <br />Trail and river frontage, each with a private single-family dock. No other lots or parcels within the <br />subdivision have Jungle Trail/river frontage. In 1969, a 0.02 acre, 70 linear foot portion of the <br />subdivision's riverfront tract (Tract A) was deeded to the County as right-of-way for public road <br />maintenance and/or drainage purposes (see Road Right -of -Way Deed, Attachment 3 to this report). That <br />County -owned strip lies between the riverfront areas of the two Riverside Estates riverfront lots/parcels. <br />County staff has become aware that a small dock, consisting of a shoreline staircase and deck, canoe / <br />kayak racks, and five mooring poles, has been constructed on and adjacent to the County -owned tract <br />without County or State permits or approvals (see photos, Attachment 4). To date, no individual has <br />admitted to performing the construction. Up until recently, the dock had a sign on it labeling it as <br />"private;" that sign has since been removed. Review of aerial photography indicates that the dock was <br />built circa 2011, and added onto since that time. It appears that the dock improvements are used for small <br />non -motorized watercraft. No parking area exists in the area of the dock and there is no potential for <br />developing parking in the subject area. <br />63 <br />
