County Commisioners <br />How we got here. A quick history <br />Morningside Drive is a short dead end street that originates on Jungle Trail and runs east. It <br />was created in 1958 as a twenty-two lot subdivision called Riverside Estates. (See A) It included <br />a small 70' wide strip of river frontage (LotA) on the Jungle Trail. The neighborhood always <br />believed we owned this property and used it as river access. Six or so years ago we improved <br />the existing access with a 7x12 deck which we use for kayaks, canoes etc. as well as simply <br />sitting. <br />People with a boat on the street rented space from Dick Jones our adjacent neighbor. When <br />the Jones property was sold to the county and the dock was closed these people moved their <br />boats to mooring pilings on the river west of parcel A. It was at this time that we looked into <br />building a dock. We arranged with a dock builder to apply for the necessary permits. We hired <br />a title company to obtain our title as the first step in the process. (See B) It was at this time that <br />we became aware that the property had been conveyed in 1969 to the county as a drainage <br />easement. <br />We then consulted an attorney to see if we could reacquire the property and found out that an <br />affordable way was to petition the county for the property but it would first be offered to the <br />abutters. We tried to get the abutters to sign off — one was willing and one was not. We were <br />stymied. This process however raised the awareness that the county owned the land on which <br />our structure existed and a series of complaining letters began being sent by the dissenting <br />abutter to the commission. <br />Our little deck improves the quality of life for our entire street as well as people using the <br />Jungle Trail who often sit to rest and enjoy the river views. <br />We ask the board to help us find a way to keep the deck open. Whether it is gifting it to the <br />county or leasing it from the county with the stipulation we provide insurance and maintenance <br />as well as keeping unrestricted public access. <br />Thank you for your time and consideration. <br />Friends of the Deck <br />73-�Z <br />
