J U L 2 1966 <br />BooK 64 pc 870 <br />WATERWAY & LOCATION: The project is located on the Indian <br />River, on Jungle Trail Road, in the unincorporated portion of <br />Indian River County. <br />WORK & PURPOSE: The applicant proposes to construct a 300 <br />square foot commercial dock with a 180 square foot deck. The <br />dock will be utilized for river access to an existing fruit <br />stand on the upland property. <br />ALTERNATIVES & ANALYSIS: <br />The Planning and Development Division reviews and submits <br />comments on dredge and fill applications to the permitting <br />agencies based upon the following: <br />- The Conservation & Coastal Zone Management Element of the <br />Indian River Comprehensive Plan; <br />- Coastal Zone Management, Interim Goals, Objectives & <br />Policies for the Treasure Coast Region; and <br />- The Hutchinson Island Resource Planning & Management Plan <br />- The Code of Laws and Ordinances of Indian River County <br />- Chapter 16Q-20 F.A.C. <br />The Indian River County Code of Laws and Ordinances does not <br />include general commercial docks as a permitted use in the <br />Agricultural Zoning District; however, the applicant's proposed <br />dock may be permitted within the agricultural zoning district <br />providing its use is limited to an access facility for the fruit <br />stand after site plan approval. <br />The proposed dock facility will be located within the Malabar - <br />Vero Beach State Aquatic Preserve and, as such, is subject to <br />Chapter 16Q-20 Florida Administrative Code. A staff review of <br />Chapter 16Q-20 finds that the proposed dock dimensions comply <br />with the size standards set forth in the rule. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners autho- <br />rize staff to transmit a letter to the D.E.R. with the following <br />comments: <br />1) The Department of Environmental Regulation and other <br />appropriate agencies should consider the potential cumula- <br />tive impacts of the dockage project upon the Florida <br />Manatee; <br />2) The Department of Environmental Regulation and other <br />appropriate agencies should evaluate the potential impact <br />of the project on ecologically significant submerged <br />bottomlands such as seagrass beds in the Indian River. <br />3) No dock construction shall be permitted by Indian River <br />County until the requirements of all local ordinances <br />related to dock facilities and mangrove protection have <br />been addressed. <br />
