rr,-- <br />JUL 16 196 <br />BOOK 65 FA,r. 9 <br />Attorney Barkett noted that the sure way to get the' <br />guarantee is to go ahead and build your house; however, the City <br />of Vero Beach does allow the docks to be built prior to the <br />primary structure, and our Environmental Planner has indicated <br />that with certain restrictions we can make these docks environ- <br />mentally acceptable. It is simply a question of whether the <br />Board wants to allow this construction.prior to the primary use. <br />Commissioner Wodtke felt the only issue at this point is <br />whether we want to allow the public hearing. He informed the <br />Board that he spent a day in Jacksonville recently with the <br />Federal Fish & Wildlife Agency, and there is a very definite <br />concern on their part re the cumulative effect of single family <br />docks. He stated that he would like to have a public hearing on <br />this. Anyone who builds a dock is going to have to go through <br />the process and acquire a permit just as if they had a house <br />there in any event; this is allowed in the City; and he <br />personally did not see it is that much of a problem. <br />Commissioner Bowman felt if we are going to permit this, <br />then we should consider that we will have a proliferation of <br />these structures and perhaps we need a local ordinance to write <br />some specifications for them. <br />Chairman Scurlock believed that the utmost concern of the <br />parties interested in having these docks is the river. He agreed <br />we should hold a public hearing because if we are going to allow <br />this, we certainly want to do it in an environmentally safe way. <br />MOTION WAS MADE by Commissioner Lyons, SECONDED by <br />Commissioner Bowman to authorize staff to schedule <br />and advertise a public hearing on the above matter. <br />Attorney Barkett felt if the Board wants an ordinance <br />prepared, it would be best to choose one of the alternatives <br />discussed previously, i.e., either to allow these docks as an <br />accessory use in all residential zoning districts and thereby <br />52 <br />
