"Fin 16.1986 <br />BOOP( 6 PAGE 12� <br />Commissioner Lyons spoke in favor of the appointment of <br />Dallas Yates to fill the vacancy on the Public Safety Advisory <br />Committee, noting that Mr. Yates is experienced in law <br />enforcement and the Resolution setting up this committee <br />indicated this was an appointment under the Sheriff's purview. <br />ON MOTION by Commissioner Lyons, SECONDED by Com- <br />missioner Wodtke', the Board unanimously appointed <br />Dallas Yates to fill the vacancy on the Public <br />Safety Advisory Committee. <br />Attorney Vitunac reported that Assistant County Attorney <br />Wilson prepared the following memo which provides the information <br />requested by the Ministerial Alliance. <br />TO: The Board of County Commissioners <br />DATE: July 10, 1986 <br />SUBJECT: Proposed Ordinances Requested by the Ministerial <br />i nce of Gifford <br />FROM: P. Wilson <br />A i ant County Attorney, <br />On June 25, 1986, the Ministerial Alliance of Gifford <br />requested that the Board of County Commissioners adopt <br />ordinances addressing several issues of concern to the <br />Gifford community. I have performed extensive legal <br />research to determine whether the requested action is <br />possible or practical from a legal standpoint and have found <br />the following: <br />I. Brown Bag Law. <br />There is no law generally applicable prohibiting the public <br />consumption of alcohol within Indian River County. The only <br />'law presently in force which.may partially restrict the open <br />+consumption of alcoholic beverages is Section 562.453, <br />T, Florida Statutes 1985, which prohibits the consumption of <br />liquor, except malt beverages, at curb or drive-in stands, <br />unless within the building of the person holding a license <br />for the sale of such beverages. This section is applicable <br />only on the property of retail establishments selling <br />alcoholic beverages. Once a person leaves the premises they <br />may openly consume alcoholic beverages. <br />The Florida Attorney General has issued an opinion stating <br />that counties may pass local ordinances prohibiting the <br />consumption of alcoholic beverages on semi-public parking <br />lots, public streets or public right-of-ways, including the. <br />transportation of unsealed alcoholic beverages in <br />automobiles. Such an ordinance was recently enacted by the <br />City of Vero Beach. 78 <br />
