Chairman Scurlock informed those present that Commissioner <br />Wodtke, who is not present tonight, has declared a Conflict of <br />Interest per the County Attorney's recommendation, which is as <br />follows; the Voting Conflict form will be put on file in the <br />Office of Clerk to the Board: <br />TO: Board of County Commissioners DATE: July 28, 1986 <br />SUBJECT: Voting Conflict on Comprehensive Land Review <br />(July 29, 1986 - Vista Properties Issue) <br />FROM: William C. Wodtke, Jr., <br />Commissioner <br />In addition to the information in the attached memorandum, <br />I wish to add that I am not a salaried employee of the Barnett <br />Bank, but as a Director of the Bank and a member of the Loan <br />Committee I do receive a fee. Based upon the opinion of Attorney <br />Vitunac and the Florida Commission on Ethics, I will not be <br />present to participate in the Vista Properties issue. <br />TO: William C. Vitunac, ounty Attorney <br />At the July 15, 1986, nighttime meeting of the Board of <br />County Commissioners for its semiannual review of the <br />Comprehensive Land Use Plan, you expressed a concern of a <br />possible voting conflict on a petition filed by Vista <br />Royale. You indicated that you are a director of Barnett <br />Bank and that one of the properties encompassed by the <br />zoning petition was owned by Barnett Bank. You also <br />indicated that you are paid approximately $1.50 per month <br />plus $50 per meeting for your attendance at the Board of <br />Director's meetings, and that as a director you have a vote <br />concerning whether or not the bank will loan money on this <br />property. <br />Section 112.3143(3), Florida Statutes, holds that no county <br />officer shall "vote in his official capacity upon any <br />measure which enures to his special private gain or shall <br />knowingly vote in his official capacity upon any measure <br />which enures to the special gain of any principal, <br />[exceptions not pertinent here], by whom he is retained. <br />Such public officer shall, prior to the vote being taken, <br />publicly state to the assembly the nature of his interest in <br />25 my F'p,;;F 247 <br />
