Boos 65 FACE 275 1 <br />ALTERNATIVES & ANALYSIS: <br />The Planning and Development Division reviews and submits <br />comments on dredge and fill applications to the permitting.. <br />agencies'based upon the following: <br />- The Conservation & Coastal Zone Management Element of the <br />Indian River Comprehensive Plan <br />- Coastal Zone Management, Interim Goals, Objectives & Poli- <br />cies for the Treasure Coast Region <br />- The Hutchinson Island Resource Planning & Management Plan <br />- The Code of Laws & Ordinances of Indian River County <br />- Chapter 16Q-20, Florida Administrative Code <br />Chapter 16Q-20 of the Florida Administrative Code sets forth <br />specific construction standards for private residential singi.= <br />docks to be located in the Indian River Aquatic Preserve, among <br />which are the following criteria: <br />Any main access dock shall be limited to a maximum width <br />of four (4) feet (16Q-20.04 (5) (b) (1) , F.A.C.) <br />The dock will extend out from the shoreline no further <br />than to a maximum depth of minus four (-4) feet (mean low <br />water) (16Q -20.04(5)(b)(3), F.A.C.) <br />Terminal platform size shall be no more than 160 square <br />feet (16Q-20.04 (5) (b) (6) , F.A.C.) <br />Both of the proposed docks exceed the maximum depth and termi- <br />nal platform size standards of Chapter 16Q-20, Florida Admini- <br />strative Code. The dock proposed by Applicant Falk also <br />exceeds the maximum width requirement for the main access dock. <br />In addition, Section 16Q-20.03(23), Florida Administrative <br />Code, defines a private residential single dock as having a <br />maximum of two (2) boat slips, in contrast to Applicant Falk's <br />proposal to construct a three (3) slip dock. <br />The Indian River County Code of Laws and Ordinances specifies <br />that residential dock structures are accessory uses to a <br />principal residential use. In order to construct the proposed <br />dock at 142 Anchor Drive, Applicant Falk must first establish a <br />principal structure on* the adjacent lot(s). The dock proposed <br />at 665 Live Oak Road is in the City of Vero Beach and therefore <br />not subject to Indian River County Code requirements. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners autho- <br />rize staff to transmit a letter to the D.E.R. with the follow- <br />ing comments: <br />1) No dock construction shall be permitted by Indian River <br />County until the requirements of all local ordinances <br />related to dock facilities and mangrove protection have <br />been addressed. <br />2) Review of the proposed dockage facilities indicates that <br />the projects do not satisfy criteria set forth in Chapter <br />16Q-20, Florida Administrative Code, relating to the <br />Indian River Aquatic'Preserve. <br />T <br />i <br />
